PLEASE NOTE: BY AGREEING TO OUR WEBSITE SALES AND TERM AND CONDITIONS BELOW, YOU ALSO HEREBY AGREE THAT YOU ARE AN QUALIFIED NAIL TECHNICIAN TO USE OUR PRODUCTS.

1.3 When we use the words “writing” or “written” in these terms, this includes emails.
Our contract with you
2.1 Our shopping pages will guide you step by steps for to place an order with NeoNail. Our ordering process will allow you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each stage of the order process.
Please take note all product colours might differ because of different resolutions in screens.
2.2 After you place an order, you will receive a confirmation e-mail from us acknowledging that we have received your order. However, please take note that this does not mean that your order has been accepted. We will confirm our acceptance by sending you an e-mail that confirms that the products have been processed. Please take note, we do not supply any products if you are not a qualified Nail Tech or a Salon owner who is placing orders on behalf of your qualified Nail Techs.
2.3 If we are unable to accept your order, we will inform you of this either by phone or in writing and will not charge you for the product. This might be because the product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified.
2.4 Our website is solely for the promotion of our products in Southern Africa.
3.1 The images of the products on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that the display of the colours accurately reflects the colour of the products. Your product may vary slightly from those images.
4.1 The costs and methods of delivery will be as displayed to you on the individual product pages and in more detail here. We do Door to Door Nationwide delivery. Standard Flat Fee is R99 (Via Courier) that is for goods up to 3kg. If it heavier than 3kg we will contact with the correct delivery fee. Delivery Fee is not included in the product prices.
4.2 During the order process, you will have contact with your chosen Agent / Head Office who will advise when they will deliver them to you. You will also receive a tracking number to track your own parcel.
4.3 We are not responsible for delays outside our control. If our supply of the products is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received.
If your parcel is not delivered within 10 Working days, please send an email with the following info:
- Order Number
- Tracking Number
- Contact Number
- Delivery Address
- Invoice number
4.4 If you are a NeoNail Agent – The product(s) will be your responsibility until it delivered to your Client / Salon
4.5 Delivery time for rural areas can take between 4-7 working days and Major cities between 2-5 days. We will only send goods as soon as we received payment.
6.1 If you made a mistake by ordering the wrong product, there will be no refund, or if there is a refund, buyer / agent will be liable for the courier fees.
6.2 Your product(s) must be returned to us or to your Agent / Head Office who you ordered from within 7 days of the order invoice date.
6.3 Refunds will be processed within 10 days of receipt of the products in our warehouse to the Representative who placed the order. We will not refund delivery fees unless the mistake is made by either the Agent / Head Office. If mistake is made by Agent, Agent will carry the courier fees for the buyer.
6.4 We do not do refunds on products that has been opened or tampered with. All products must be send back for us to us in original packaging and resalable condition. All products will be inspected first.
6.4 Agent / Head Office will then refund you as per your arrangement.
Price & Payment
7.1 The price of the product (which includes VAT) will be the price indicated on the order pages when you place your order. We take all reasonable care to ensure that the price of the product stated is correct.
7.2 It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced, if you do come across one of those products please send the info to email@example.com. We will then be in contact with you.
7.3 If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable.
7.4 We only supply the products for Professional use only and Qualified Nail Technicians. We do not take responsibility if you use our products and you are not qualified. When you do your first purchase you must send us your qualification.
7.5 If you use NeoNail in conjunction with any other products on the nail we do not take any responsibilities if the product fails to work.
Other Important Terms
8.1 Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
8.2 If we decide to change these terms, we will post the new version on the website. Any orders placed after this time will be subject to the new version.
8.3 If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
8.4 These terms are governed by South African law and you can bring legal proceedings in respect of the products in South African courts.
